Banky Terms of Use

Banky is an app for finding benches, adding them and walking to them. Banky is a personal project by Niek Spermon, the Netherlands ("we"). By creating an account and tapping "Agree", you accept these terms and the privacy policy.
Zero tolerance for objectionable content or abusive users. We remove anything listed under "What is not allowed", and people who break these rules may lose their account.
1. Who can use Banky?
- You need to be at least 13 to have an account.
- If you are 13, 14 or 15, you need permission from a parent or guardian.
- Without an account you can view the map with benches.
2. Your account
- Keep your password secret. You are responsible for what happens with your account.
- Choose a display name that isn't offensive and doesn't impersonate someone else. It is better not to use your full real name.
- You can always delete your account yourself in the app (Account → Account settings → Delete account).
3. What is not allowed
In Banky (in photos, display names, descriptions and reports) you may not post or do anything that:
- is sexual, nude, violent, threatening or shocking;
- is offensive, discriminatory or hateful, for example about origin, religion, gender, sexual orientation or disability;
- bullies, harasses or ridicules someone;
- shows people in a recognisable way without their permission, or shares other people's private details (such as addresses or phone numbers);
- isn't yours (for example photos taken by others or found online);
- is fake or misleading, such as benches that don't exist, spam or fake accounts;
- abuses the app or its data, for example tricks to earn XP, faking your location or using the app in ways it isn't meant for;
- breaks the law.
4. Reporting, blocking and what we do
- See something that isn't allowed? Report it in the app: a bench with the flag on the bench's page, a profile or photo with the small "…" button. You can also block someone.
- We review reports within 24 hours. We remove content that isn't allowed. For serious or repeated violations we delete the account.
- A photo reported by three different people is hidden immediately until we have reviewed it.
- Swear words in names and descriptions are blocked automatically.
5. What you share
- Photos, benches, descriptions and ratings you add remain yours. You allow us to show them to other users in Banky for as long as they are in Banky.
- Other users see your display name with what you share. See the privacy policy for what others can and can't see.
- If you delete your account, we also delete your benches, photos and the rest of your data.
6. Stay safe on the way
- Banky helps you find your way, but stay alert: watch the traffic, follow signs and closures, and don't enter private property.
- Benches, routes and directions can be outdated or wrong. A bench may be gone, broken or unreachable.
- Don't use the app while cycling or driving.
- Meeting someone you only know through Banky? Do it in a public place and tell someone where you are. If you are under 16, talk to your parent or guardian first.
7. Availability and liability
- Banky is free. We do our best to keep it working well, but can't promise it will always be available or free of errors.
- As far as the law allows, we are not liable for damage caused by using Banky or by content from other users.
- We may change the app or stop it.
8. Changes and law
- If these terms change in substance, the app asks for your agreement again.
- These terms are governed by Dutch law. If you live in another EU country, you keep the protection the law of your country gives you as a consumer.
